DMCA Policy

Effective from June 30, 2026. This policy governs how HostLaza processes copyright infringement notices and counter-notifications in accordance with applicable law.

Introduction

HostLaza ("HostLaza", "we", "us", or "our") respects the intellectual property rights of others and expects all customers using our services to do the same. In accordance with applicable copyright law, HostLaza has adopted this Digital Millennium Copyright Act ("DMCA") Policy to address claims of copyright infringement involving content hosted on our infrastructure.

This Policy provides copyright owners and their authorised representatives with a structured process to report allegedly infringing content hosted on HostLaza's servers, and provides affected customers with a process to contest such claims through a counter-notification procedure.

This DMCA Policy Is Part of Your Agreement With HostLaza
Repeated or confirmed copyright infringement may result in the suspension or permanent termination of the associated hosting account, without prior notice or refund.

Who This Policy Applies To

This DMCA Policy applies to the following parties:

  1. Copyright owners or their authorised agents who believe that content hosted on HostLaza's infrastructure infringes a valid copyright they hold
  2. HostLaza customers whose content has been removed or disabled in response to a DMCA takedown notice and who wish to dispute the removal through a counter-notification
  3. All users of HostLaza services, who are required to ensure that content they host does not violate the intellectual property rights of any third party
Reseller Account Holders If you operate a reseller or master reseller hosting account with HostLaza, you are responsible for ensuring that all accounts created under your reseller plan comply with this DMCA Policy. HostLaza may hold you accountable for DMCA violations occurring on accounts you manage.

Reporting Copyright Infringement

If you are a copyright owner — or an agent duly authorised to act on behalf of a copyright owner — and you believe that content hosted on HostLaza's infrastructure is being used without authorisation in a manner that infringes your copyright, you may submit a formal DMCA takedown notice to HostLaza.

Before Submitting a Notice Please carefully review the allegedly infringing material to confirm that you own the copyright in the work being used and that the use does not fall under a licence, fair use, or other lawful exception. Submitting a notice without a good-faith belief that infringement has occurred may expose you to legal liability.
HostLaza processes DMCA notices during regular business hours. We aim to acknowledge all valid notices within one to two working days of receipt and will take appropriate action as promptly as reasonably possible after confirming the notice is complete and valid.

Required Information for a Valid DMCA Notice

To be considered valid and actionable, a DMCA takedown notice submitted to HostLaza must include all of the following information. Incomplete notices may not be processed.

Your DMCA Notice Must Include
  1. A clear identification of the copyrighted work you claim has been infringed — or a representative list if multiple works are involved
  2. The exact URL or precise location of the allegedly infringing content on HostLaza's servers, with sufficient detail to allow us to locate the material
  3. Your full legal name, physical mailing address, telephone number, and email address so that HostLaza may contact you regarding your notice
  4. A statement that you have a good-faith belief that the use of the material in the manner described is not authorised by the copyright owner, its agent, or the law
  5. A statement, made under penalty of perjury, that the information provided in your notice is accurate, and that you are the copyright owner or are authorised to act on behalf of the copyright owner
  6. Your physical or electronic signature as the copyright owner or their authorised representative
Notices that are incomplete, vague, or lack sufficient identifying information may be disregarded. HostLaza reserves the right to request clarification or additional information before processing a notice.

Where to Send DMCA Notices

All DMCA takedown notices must be submitted to HostLaza's designated abuse contact. Using an unofficial channel — including live chat or social media — will not result in a formal DMCA action being taken.

Submit Your DMCA Notice Through
Please allow reasonable time for our team to review your notice and investigate the reported content. Submitting multiple duplicate notices for the same content does not accelerate the review process.

Action Taken by HostLaza

Upon receipt of a DMCA takedown notice that appears complete and valid on its face, HostLaza will review the matter and may take one or more of the following actions at its sole discretion:

Step 1 Review the Notice: HostLaza will assess the notice for completeness and verify that sufficient information has been provided to identify the allegedly infringing content.
Step 2 Notify the Account Holder: Where feasible and appropriate, HostLaza will notify the affected customer that a DMCA complaint has been received concerning content in their account.
Step 3 Remove or Disable Access: HostLaza will remove or disable access to the allegedly infringing content to comply with the takedown request while the matter is under review.
Step 4 Document the Action: A record of the takedown notice and the action taken will be maintained by HostLaza in accordance with applicable record-keeping obligations.
HostLaza acts as a hosting provider and does not make editorial judgements about the content of its customers' websites. Our response to a valid DMCA notice is an operational action, not a legal determination of infringement.

HostLaza's Rights

In connection with this DMCA Policy, HostLaza expressly reserves the right to:

  • Remove allegedly infringing content from its servers promptly upon receipt of a complete and valid DMCA notice, without prior notice to the account holder
  • Disable access to reported material while a notice or counter-notification is under active review
  • Request additional information from the complainant or the account holder before proceeding with a takedown or restoration
  • Reject incomplete, defective, or fraudulent notices that do not meet the requirements set out in this Policy or applicable law
  • Suspend or terminate accounts belonging to repeat copyright infringers without prior notice or refund
  • Cooperate fully with law enforcement and relevant authorities in cases involving confirmed or suspected copyright infringement where legally required
  • Update this policy at any time to reflect changes in law, technology, or HostLaza's operational practices
HostLaza's decision to remove, disable, or restore content in response to a DMCA notice or counter-notification is made in good faith and does not constitute a legal determination regarding the validity of the underlying copyright claim.

Counter-Notification Process

If you are a HostLaza customer and you believe that content in your hosting account was removed or disabled as a result of a mistake or misidentification — for example, because the content is your original work, you have a valid licence, or its use constitutes fair use — you may submit a formal counter-notification to HostLaza.

What Happens After a Counter-Notification Is Filed
  1. HostLaza will review the counter-notification for completeness and validity
  2. If valid, HostLaza will forward a copy of the counter-notification to the original complainant
  3. The complainant has 10 to 14 business days to seek a court order preventing restoration of the content
  4. If no court order is obtained within that period, HostLaza may restore the removed content at its discretion
Filing a counter-notification means that you are consenting to the jurisdiction of a court to resolve the copyright dispute between you and the original complainant. Please consider consulting a qualified legal professional before submitting a counter-notification.

Requirements for a Valid Counter Notice

A valid counter-notification submitted to HostLaza must contain all of the following elements. Incomplete submissions may not be actioned.

Your Counter Notice Must Include
  1. An identification of the content that was removed or to which access was disabled, and the URL or location where it appeared before removal
  2. A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification
  3. Your full legal name, physical mailing address, telephone number, and email address
  4. A statement that you consent to the jurisdiction of the appropriate court in the district where your address is located, and that you will accept service of process from the party who submitted the original DMCA notice
  5. Your physical or electronic signature

Repeat Infringement Policy

HostLaza takes copyright protection seriously and maintains a policy of terminating the accounts of customers who are found to be repeat copyright infringers.

What Constitutes Repeat Infringement
  • An account that has been the subject of multiple valid DMCA takedown notices within a twelve-month period
  • Accounts where infringing content is re-uploaded after removal in response to a prior DMCA notice
  • Accounts used to deliberately and systematically distribute copyrighted content without authorisation

In cases of confirmed repeat infringement, HostLaza reserves the right to permanently terminate the hosting account without prior notice and without issuing a refund for any remaining service period. HostLaza may also report the matter to the relevant authorities where appropriate.

False or Fraudulent Claims

The submission of a false, misleading, or fraudulent DMCA notice or counter-notification is a serious matter with significant legal consequences. Under applicable law, any person who knowingly and materially misrepresents that content is infringing — or that content was removed by mistake — may be liable for damages, including costs and legal fees.

HostLaza Reserves the Right To
  • Reject any DMCA notice or counter-notification that HostLaza reasonably believes to be false, abusive, or submitted without a genuine good-faith basis
  • Terminate access for any party that repeatedly submits fraudulent or bad-faith DMCA notices
  • Refer the matter to the appropriate legal authorities where fraud or abuse of the DMCA process is confirmed

Policy Updates

HostLaza Reserves the Right to Update This Policy HostLaza may revise, update, or expand this DMCA Policy at any time to reflect changes in applicable law, evolving technology, regulatory requirements, or HostLaza's operational practices. All updates will be published on this page with a revised "Last Updated" date.
